The Cyprus Securities and Exchange Commission (CySEC) announced on Friday that Depaho Ltd, an investment firm, will be allowed until the end of the month to proceed with the necessary actions to comply with the provisions required by the regulator. In fact, CySEC has extended the suspension imposed on the company.
According to the oversight, Depaho has been given a specific deadline until the end of September 2021 to take the necessary actions to comply with the relevant provisions of the Investment Services and Activities and Regulated Markets Act 2017 and Regulation (EU) No. 600/2014.

While the suspension continues, the investment company is now permitted to provide or carry out investment services or activities, to enter into any business transaction with any person, and to accept new clients. Furthermore, Depaho is not allowed to promote itself as an investment services provider. Accordingly, CySEC has established that: “The Company may, provided that this is consistent with the wishes of its existing clients, proceed with the following actions, without such actions being considered as a violation of Section 7(a) of DI87-05: all of its own transactions and those of its clients offered to it, in accordance with the client’s instructions; to return all funds and financial instruments belonging to its clients.”

Early in July, CySEC reported that Depaho Ltd had violated Section 5(1) of the Investment Services, Activities and Regulated Markets Act 2017, whereby the company is alleged to provide investment advisory services as a normal profession “without prior authorization” by the financial supervisor. The watchdog also alleged that the company appeared to lack an understanding of the financial instruments it offers or recommends, alleging a violation of Section 25(2)(b). In fact, the watchdog added that Depapho Ltd does not appear to be providing transparent, fair and non-misleading information via its marketing campaigns.
